Russia & China Block Security Council Referral of Syria to International Criminal Court

In February 2013, UN-appointed Commission of Inquiry concluded ICC is appropriate venue to pursue fight against impunity in Syria. “If members of Council continue to be unable to agree on a measure that could provide some accountability for ongoing crimes, credibility of this body & of entire Organization will continue to suffer.”

UN failing its own principles in Syria? Recently UN offered new guidelines for mediators in how to address evidence of grave violations of international humanitarian law. New code of conduct is intended to discourage impunity & turning a blind eye, (a behavior that eventually contributed to further crimes & legitimization of consequences/fruits of such in Bosnia & Herzegovina & several other conflict zones.

None have joined the International Criminal Court, but India, Pakistan, Israel & North Korea have become “nuclear club” members & Iran may have similar ambitions. The US, Russia & China are also nuclear weapons powers while viewing themselves above the rule of law, at least as far as the ICC is concerned. As permanent UNSC members, they can refer other states to ICC all ostensibly in name of international peace & security.

The International Criminal Court has fulfilled part of the original mandate envisioned under the Rome Statute & delivered precedent of reparations for victims, in this case, child soldiers. The ICC on announced former child soldiers who suffered at  hands of convicted Congolese war criminal Thomas Lubanga Dyilo, may receive reparations from Court’s donor-financed Trust Fund for Victims. –WATCH–

Blog Report: LIBYA “URGED” BY UN SECURITY COUNCIL TO RELEASE 4 ICC STAFF, By Ambassador Mo
A “Press Statement” representing consensus of all 15 members, the UNSC “urge(d) Libyan authorities at all levels & all concerned to work towards immediate release of all ICC staff members.”  Statement highlighted it is legal obligation of Libya under Security Council resolution 1970, which referred situation in Libya to ICC (International Criminal Court) last year, to cooperate fully.  –More–
